The ruling came during a brief court hearing Wednesday for 21-year-old Roman Paul Morales. Morales was arrested on suspicion of first-degree murder after police found Donnie Romelo Romero unconscious on Monday in the apartment where he lived with his mother outside of Denver. Police found the boy shortly after he had been reported missing. He was later pronounced dead at a hospital.

Investigators say Morales had been in the apartment before police arrived and officers were able to find him soon afterward.

Authorities won’t say how the boy died, and court documents in the case have been sealed.
