The U.S. Supreme Court ended its session Monday not just with a bang, but with the nuclear annihilation of one of the most critical tenets of American government as it was created in 1776: the preclusion of an American king.
Six conservative activist jurors on the high court picked up where Richard Nixon once left off when he declared aloud that Americans in the 1970s wanted to know if he, as president, was a crook.
“I am not a crook,” Nixon famously, and erroneously said. His warped logic, mistaken at the time, was that if the president did something, it could not be illegal.
On Monday, the high court majority rekindled and enshrined that ludicrous and nefarious tenet, declaring that President Trump is not a crook, because he was a president.
In the historical 6-3 decision, the Supreme Court ruled that Trump, as president, is immune from criminal prosecution for trying to force then Vice president Mike Pence to undermine the will of voters in several states by contriving to change the actual results of the election and make Trump president again.
What was once an absurd and darkly comical supposition by lawyers and justices even considering the question of Trump’s absolute immunity has now become fodder for public alarm.
Months ago, a lower court in the case was asked whether such nonsense as absolute presidential immunity would make it legal for a president to assassinate a political rival, Trump’s lawyers answered, “yes.”
Writing for the conservative majority on the high court yesterday, including Justices Samuel Alito and Clarence Thomas, both sullied by recent pro-trump political scandals, Chief Justice John Roberts backed such a dangerous and risible notion.
Roberts and complicit justices agreed that Trump should be immune from prosecution for trying to force Pence to overthrow Congress and undermine the election so he could stay in power, and that even Trump’s actions as a criminal could not be used as evidence against him. The argument is indefensible.
Nowhere in American history from the Founding Fathers forward has there been any push for or suggestion of absolute immunity for the chief executive, before or after he or she leaves office.
We agree with Justice Sonia Sotomayor, who wrote, “In every use of official power, the President is now a king above the law. Because our Constitution does not shield a former president from answering for criminal and treasonous acts, I dissent.”
She and hundreds of critics said the foul ruling “makes a mockery of the principle, foundational to our Constitution and system of government, that no man is above the law.”
In what is the worst of all possible scenarios, should Trump be elected again, he would have free rein to turn the power and forces of the U.S. government against his enemies and critics, without fear of reprisal or accountability.
And this is a man who has repeatedly, publicly, threatened to do just that.
Trump would be permitted by activists on the Supreme Court to operate death squads by using his official powers as president to initiate such terrorism.
The ruling justifiably strikes fear in millions of Americans who worry they could be construed as enemies of Trump and his so-called MAGA nation and be subjected to his infamous malevolent whims.
For those political leaders who currently feel smugly confident in their value to Trump, look at the long and growing list of the enemies Trump has openly sworn against, all Republicans and often former allies in his own White House.
Those who are currently confident about staying in Trump’s good graces ignore his mercurial recent past.
Members of Congress in both houses and from both parties should immediately convene with qualified legal scholars to create a constitutional remedy to the crisis this rogue court has created.
No political party, no American, no nation can survive a government that allows its chief executive unlimited power and absolute immunity not just for committing crimes against citizens or even the nation, but even precluding prosecution for conspiring to undermine the very threads of democracy that have bound the United States for more than two centuries.
Nice written tantrum. This diatribe was completely lacking in reason and based entirely on emotion. If this ruling was made in favor of Biden, the writer would be elated. This ruling is not based on Trump…..it is based on common sense and applicable to ALL presidents. It is also ONLY applicable to a president’s OFFICIAL acts. This means that ANY president who commits a crime outside of his official duties absolutely CAN be prosecuted. One example that was brought up is the death of a US Citizen resultant from an order from Obama to authorize a drone strike. Should Obama be subject to a lawsuit because his order resulted in the death of someone’s loved one? No he should not be. The same SCOTUS ruling applies to Trump, but due to TDS, the author has a meltdown. Perhaps the author is simply scared that this ruling opens the door for the Biden Crime Family to face accountability for its actions. Its been amusing watching the Left pout when their emotions are bruised.
