AURORA | Police plan to file first-degree murder and several other charges against a man they say slammed into a Camaro early Monday morning, killing the 17-year-old driver.
Ever Olivos-Gutierrez, 40, of Aurora remains hospitalized with injuries he sustained during the crash near East Colfax Avenue and Dayton Street. Police said this afternoon that officers are guarding Olivos-Gutierrez and he will be booked into jail as soon as he is released from the hospital.
Police said Olivos-Gutierrez, who is in the country illegally, has never had a valid driver’s license and has a lengthy traffic record that includes three DUI convictions. Investigators believe he was drunk and speeding at the time of the crash.
The driver of the Camaro, Carlos Dominguez-Palomino, died at the scene.
Police plan to charge Olivos-Gutierrez with several crimes, including: one count of first-degree murder, two counts of vehicular homicide, two counts of driving while a habitual traffic offender, DUI, driving with excessive alcohol, reckless driving and driving a vehicle that wasn’t equipped with an Interlock device.
A conviction on the first-degree murder charge alone would carry a mandatory sentence of life without parole.
Police said the federal Immigration and Customs Enforcement division has told investigators that Olivos-Gutierrez came to the United States on a visitor visa in 2003, but the visa expired the following year.
Olivos-Gutierrez’s mug shot has not been released because he has not yet been booked into jail.


“…who is in the country illegally, has never had a valid driver’s license and has a lengthy traffic record that includes three DUI convictions.” So, exacty what is it going to take? His “visa” expired in 2004, TEN YEARS later he’s still here with a “LENGTHY TRAFFIC RECORD”. Had this been some politicians’ son, imagine the outcry we’d be hearing about ILLEGAL ALIENS! (Oops, I mean undocumented workers!) Either we get the government to do its flippin’ job or there will blood in the streets of this nation!
Why wasn’t he deported at least after the first DUI? Who keeps track of expired visa? Why aren’t our laws enforced. The only thing that is broken in our immigration laws is the ENFORCEMENT of them. If our laws had been enforced since we gave amnesty there wouldn’t be any illegals here.
Our lawmakers are a joke. Why should anyone obey the law since they are not enforced? Wait, it depends what country one is from whether they must be lawful.
