A man who police say shot an innocent bystander during a 2010 liquor store robbery in Aurora is scheduled to go on trial next week.

Anthony Gillespie, 25, is scheduled for a two-week jury trial in Arapahoe County District Court starting Monday, according to court records.

Gillespie faces murder and other charges in connection with the April 9, 2010, robbery at Sixth Avenue Liquors that left Benigno Morales-Ramirez, 24, dead.

In the days after Morales-Ramirez’s death, police arrested another man, Elon Raynell Wynn Robinson, 23, in connection with the crime. Robinson was shot during the robbery, according to police records.

Morales-Ramirez appeared to be an innocent bystander who had gone to the store that night to buy beer, police said.

According to Colorado Bureau of Investigation records, police in Denver arrested Gillespie a few months after the shooting when Aurora police filed charges against him, including first-degree felony murder and aggravated robbery.

He has been held without bond at the Arapahoe County Jail since.

According to an arrest affidavit, Robinson was shot in the arm and hip during the robbery and later arrested at an area hospital. Robinson later pleaded guilty to aggravated robbery and late last month sentenced to 32 years in prison.

Police also identified a third suspect in the case, according to the affidavit, but that man has not been charged.
