Police said the pedestrian may have been intoxicated.

The man driving the SUV was not speeding and did not appear to be under the influence, police said. He is cooperating with the investigation, police said, and has not been charged with a crime.

Police said based on the initial investigation the pedestrian appears to be at fault.
