CENTENNIAL | Attorneys for the man charged with murder in the Aurora theater shootings say the release of his mug shot violates a judge’s gag order.

Arapahoe County sheriff’s officials released a photo of James Holmes on Sept. 20 showing him with short brown hair. He had longer orange-red hair when he was arrested after the July 20 shootings that killed 12 people and wounded 58.

In court documents released Wednesday, Holmes’ attorneys say the mug shot affects his prospects for a fair trial. They want to know how it was released. A hearing on the complaint is set for Oct. 11.

Sheriff Grayson Robinson tells KUSA-TV in Denver (https://on9news.tv/Px6oXK) he checked with appropriate authorities before the release. A court administrator says she only remembers saying she’d forward requests for the photo to sheriff’s officials.
