The judge set the new date Wednesday. The hearing was set for this week, but the judge postponed it after saying prosecutors had made contradictory statements about their request.

Holmes pleaded not guilty by reason of insanity to charges of killing 12 and injuring 70 in 2012. His trial has been postponed while attorneys argue over further psychiatric evaluation.

Holmes underwent a sanity evaluation in the summer but the findings haven’t been made public.

Defense lawyers, meanwhile, say they haven’t decided whether to appeal a New York court ruling that a New York-based reporter doesn’t have to testify on a side issue in the case.
