AURORA | The city attorney and police chief are pushing a measure that would make it harder for police officers to successfully appeal their discipline.
City Attorney Charlie Richardson announced the proposal at a meeting Tuesday of City Council’s Public Safety committee. Under current rules for the city’s Civil Service Commission, when an officer is disciplined and appeals to the commission, the burden of proof is on the city to prove the discipline was appropriate.
Richardson’s proposal calls for shifting that burden to the officer, forcing them to prove that the discipline was inappropriate.
The change is necessary, Richardson said, because under the current rules disciplinary appeals last several days, and sometimes a full week.
“They last longer than some federal trials,” he said.
If city council backs the plan to change the rules, it would go before the voters this fall.
Leaders of both the police union and firefighters union said Jan. 7 they would oppose any changes to commission’s rules.
Mark Finnin, president of the Aurora Police Association, said the union has been open to changes that would make the appeals shorter, but they will adamantly oppose any ballot measure that would change the commission’s role.
Several officers in recent years have successfully appealed their discipline to the commission and had their punishment overturned. In one case, an officer arrested twice on DUI charges got his job back after the chief fired him In another case, an officer fired after he called a man he shot a “marshmallow head” among other infractions was reinstated.
The Public Safety Committee voted Jan. 7 to send the question to the full council.
Councilwoman Barb Cleland, who chairs the committee, said city lawmakers will have to make a decision by July whether to get the measure on next fall’s ballot.
Cleland said she expected a bruising fight over the question.
“There will be some lively discussion,” she said. “Which is not all bad.”
In 2006, Police Chief Dan Oates backed several ballot measures aimed at changing civil service rules as they relate to hiring and promoting officers. Those questions didn’t touch on the commission’s role in discipline cases.
After the police and fire unions outspent supporters of the measures by a 300-to-1 ratio, voters rejected the most-far-reaching of the four questions, approving two other minor changes. Oates said at the meeting he backs the current changes.
Bernard Celestin, chair of the civil service commission, said he opposes the changes. Under the current system commissioners take their role very seriously and make sure to give each side equal consideration, he said.
“I believe it would be a mistake because it works,” he said.
Citizens of Aurora, let me break it down for you while I play Elvis Presley’s song Suspicious Minds.
Rumor has it in A-town that Charlie Richardson a.k.a. “Checkbook Charlie”, would love to be appointed to the position of Independant Monitor should we have one. If true, that explains why Chief Oates and Richardson went from one-upmanship to cuddle buddies on this deal.
In my opinion, Oates is nothing short of a control freak and ego maniac. He has destroyed the morale of our police department almost entirely. This of course with the help of his “Winkies” (the guards enslaved by the wicked witch in the Wizard of Oz) or, better known as his current upper chain of command.
Bernard Celestin is dead on to oppose the proposed. The Civil Service Commission is comprised of citizens who should carry on as usual in their appointed duties. No changes to charter Charlie.
Let me remind everyone of this little tidbit: Chief Oates fired Officer Falco for protecting his own life in a manner that broke this Chiefs policy but not law. (Civil Service, the D.A. and a Judge found in favor of this officer by the way). Then our city attorney approved of cutting a big fatty to the criminals and their families too? They both got it wrong.
It is my belief they each wield powers that shouldn’t be left unchecked. While I can only speculate as to why they climbed in bed together, I won’t put my stamp of approval on the further spooning they’ll be doing, if we give them what they want!

When the city fails not just twice, but multiple times to fire officers in Civil Service hearings, the tax-payer/citizen may want to ask, “Why?”
Could it be… A) The Civil Service Commission are a collection of Union Minions who routinely condone alleged misconduct of “bad cops”? or… B) The Chief of Police and City Attorney routinely collaborate to violate the principles of due process and rule of law?
It has been proven in Civil Service hearings that “outcome based investigations” of alleged misconduct is the normative method of the Police Chief and City Attorney. Rather than finding the facts to lead to a conclusion; they reach a conclusion and cherry-pick whatever facts they can use to support it, discarding all others that may conflict with personal desires.
Now that they have failed repeatedly, they ask a City Council to consider asking the electorate to change the rules and place the burden of proof for innocence on the accused. This flies in the face of our long established American judicial principle where the burden of proof for establishing guilt falls upon the accuser.
Never-mind that the standard of proof in a Civil Service hearing is much lower than a Criminal Court: “preponderance of evidence” rather than “proof beyond a reasonable doubt”. Hence it is vastly easier to “convict”. And they still lose.
Daniel J. Oates and Charlie Richardson have failed time and again in the arena of the judiciary, not just Civil Service, but even in appeal to the District Court. This is in spite of each being a holder of Juris Doctor degree.
Councilwoman Cleland is quoted as, “There will be some lively discussion,” she said. “Which is not all bad.” How about some lively discussion about the real reasons behind these “failures get rid of bad cops?”
How about some lively discussion regarding the real “bad cops” such as Mangino and Sellman and the years that they remained on the job in spite of the Police Executive having prior indications of their felonious activities?
When you are being distracted by tantalizing stories about excessive force (Waselkow re-instated because it did not happen); DUIs (Sears re-instated because of a plethora of rights violations by the now unemployed Parker Police Officer who arrested him); and sugary-confection-craniums (Falco re-instated because time and again ego driven discipline trains derail when subjected to judicial scrutiny)… ask yourself and maybe your Councilperson what is really going on here?
Ask yourself the fundamental question already answered in our national history… who should have to bear the burden of proof? The accuser (almost always the State or City) or the accused (an individual)?
I agree. This nation as a whole is becoming on big police state. Police have forgot their motto to protect and serve. The commission should have the ability to fire officers that have broken the law.

Yes, it is out of control. At the federal, state and local level. One big fat police state. I am retired military and I am am fearful for our liberty. Department of Homeland road block checks, these are so called immigration checks, but they run drug dogs around your cars. When Mayor Hogan was a council member, he and Barb Cleland were married. She also sat on council but, with a different last name most didn’t know they were together.
Both Hogan and Cleland are friends with Charlie. I’m not sure if it’s true but, somebody whispered in my ear that Charlie and Cleland just returned from a shared vacation.
By my calculations, Charlie has been employed by the city for 38 years. If you think he won’t have groomed his successor or have input on who takes his place, think again.
Hogan casually mentions the need for an independant monitor and council pretends to balk at the idea.
Now, Cleland takes her turn as the head of the Public Safety Committee and one of the first things they tackle is this? This makes the top of the list? Why?
Oates has been applying for chief positions left and right and yet nobody takes him off our hands. If he stays, you can bet he will want more power and is working behind the scenes with the rest of them.
Would someone tell me why it is that a street cop is not allowed to voice an opinion concerning the welfare of this city but, Oates can be in uniform on a piece of literature that promotes Arapahoe House for Molly Markert and he wiggles out of it?
Why is it that a Division Chief with 11 years experience in that position, isn’t allowed to voice an opinion with Civil Service that differs from the Chief’s without being demoted to the rank of Commander? After all his years on the force, this is what took him down? Exercising his 1st amendment rights?

Here is my understanding and opinion concerning the theatre shooting.
Every officer working for APD was given an award by the chief. To include people who weren’t on duty at the time and even those who were out of state.
I’m curious to this day, if Chief Oates ever officially acknowledged with awards, the officers in surrounding agencies that flooding in from every direction to help APD?
Last I heard, Chief Oates sent an email of thanks.

I just watched the interview with you on channel 7 news. I noticed at the end, the reporter said “how did the settlement come to be”?
He mentioned a protest of the criminals familes and that the city attorney ran outside and got a dialogue going with them. This eventually led to a settlement. Wow.
If there’s someone who is well versed in how to get rid of or quiet protester’s when they are saying something that negatively impacts city hall, it’s Chief Dan Oates. (See my earlier post and research his background to learn more about him).

I’ve been wondering what happened to the rape victim that couldn’t get her rapist convicted due to the DNA being destroyed. That story dried up pretty fast after the chief visited her, explained and apologized. Seems too good to be true, doesn’t it? What about all those other people too? Where did they go and what was their outcome?

Furthermore, let me turn the tables on you. Let’s not believe everything we read like the press by you keeping the crime down to an unbelievable percentage.
If crime is slow in Aurora, then why have you created an entire unit just to handle burglaries? I am here on my own merit because you do this to people, back at you!
How much longer Skip Noe, and Mayor Hogan are you going to keep a crook around…… How much more do you want because I am finding it and I will send it to you. I have had enough of this man torturing my family and I told you that one day I would never STOP!

Ashley, where are you! I need names of those CSC staff., by the way today Falco and Jason McIrvin were to hear their discipline from Oates to be Fired or Suspended WITHOUT pay but it has been postponed. I love it, thank you!! And, I did fax Honorable Harold Baer, documents asking is this a lie and kinda a brief detail about the discipline actions for a shooting in 2011, that these guys have been hauled through.
Let me do more digging around to see what steps these two officers can take should a firing happen over this chiefs policy.
I called H. Baer’s office about article and how Oates states false. I will get a respond next I hope… maybe more dirt.
Not sure on APA, I know they are supported 100 % but just don’t know how much of that they can do, did, or should?
If they are fired or docked pay, they should seek legal council and if advised, file lawsuits.
The first item up for bid, should be Oates policy enforcement which is causing undue stress and fear of financial loss. It’s already been determined to be a justified shooting.
If Falco made negative comments to other officers, that should rate as a written warning in his file.
If Falco after closing time at the municipal building babysat a grandchild during a family emergency, that too should rate as another written warning. Especially since the chief himself has brought both of his own daughters to the district during the day, time and again. To include a daughters boyfriend.
In addition, another officer has done a ride-along while on duty with his minor child sitting in the passenger seat of a squad car. Was that officer written up?
You see, it appears as if this is a case of the do as I say not as I do and not applying the same discipline across the board to all.
Can you tell me why McIrvine is now in a special unit and Falcos treatment seems egregious in comparison when they both fired their weapon?
Oates has bad blood against Falco, and thought Falco would just go away but as you know Falco will retire or go when he is ready. He has done nothing wrong to be fired. Falco is DRE-DUI expert and Falco testified on stand on Mark Sears case. Oates and Sears can not stand eachother, go figure Sears got his job back and rumors that Oates was pissed off. I don’t think that after 19 years Falco does not brown nose and firmly can’t prove Oates hatred towards him but I honestly think Oates thought he could get rid of Falco thinking he has no means to fight back, and Oates ego and pride is being put to the test. Its hard to say but I think its personal attacks and hatred because Falco won’t back down why should he, he has done nothing wrong except piss off Oates.
Falco was cleared of it all, everthing except having our grandchild at a lock closed facility just 45 minutes before shift ended and it was an emergency situation. It was someone that had seen them and ran to Oates, that how that happened and yes, when it comes to Falco being watched by Oates spies he can’t even sneeze before someone tells on him. Giuliani was right about Oates, that I can truly support.
By the way, all of the CSC staff has what they need by email with the articles. Falco is represented by a union attorney Brian Reynolds, who is sharpe and knows Oates is nothing but a sick man running a bureau, who is dangerous to us and the public his demeanor is one of a controlling evil narcisstic person who needs pulled out and yes, I want him fired and gone we have a great City and POLICE department that needs to be ran honestly with support and not some monster.

Okay, I did.
Well, I had to email the chief and I don’t care any more. I did mention to oates the revealed violation revealed by Judge Harold Baer Jr., in New York against Oates and Giuliani’s commentary about Dan Oates and his spy policing tactic. Sounds like oates has no friends in NY., and no job. There is more once I reach Judge Harold Baer’s officer and left message with GIULIANI’S web site pleading to save my husband and his job from his vicious attempts to suspend, fire and whatever turns the chief on.
What is Oates and Charlie going to say when Falco’s union attorneys make them look stupid again? Is Oates going to say its the civil service fault again? I just want to be Falco because civil attorneys are going to call him to take his case.

and Oates are just pissed because the city attorney’s office is full of
attorneys that are not good enough to practice on their own. Furthermore if
Charlie and Oates had validated reasons to fire officers then they would not be
overturned. Officers only go to civil service when they have been wronged by
the almighty Oates and Charlie and they know that they did nothing wrong. Oates
has a Hitler complex and thinks that he is the almighty. Maybe the public
should go to Parker PD and Aurora PD and asked for the locked out reports of
his daughters being contacted by both the Parker and Aurora PD and lying to the
cops. The apple obviously does not fall far from the tree. As for Charlie and
Oates whining about the beating they took in Falco’s hearing. I have on good
authority that Falco will be having an open hearing about the shooting on
Laredo and that he also has documents that will show Oates and Charlie tried to
manipulate the first civil service hearing. I would asked that the public and
the press go to that hearing and I will contact Falco to make sure of the date.
Guess who got kicked to the curb? Bernard Celstin, that’s who! Looks to me like Mark Finnen and his APA (Aurora Police Association) once again, have no teeth. You get up there in front of council last Monday, to defend the officer’s rights and council treats you like you’re just up there gumming it. What else is new?
