CENTENNIAL | Aurora theater shooting suspect James Holmes raised even more questions when he appeared in court Monday morning, looking wide-eyed and dazed, his hair dyed bright orange in an uncombed tangle atop his head.

Holmes, 24, appeared before Chief Judge William Sylvester for only about 15 minutes and said nothing, appearing to some observers to be drugged and unsure what was going on.

When he walked into the room, Holmes’ mismatch of colors were striking — bright orange hair, a maroon Arapahoe County Jail top, scarlet pants that only reached the top of his ankles and orange, jail-issued sandals.

Several onlookers had been anxious to see whether Holmes’ hair was in fact dyed. Last week, New York Police Chief Raymond Kelly told a reporter that Aurora police told him the shooter dyed his hair and called himself the Joker after the shooting during a midnight screening of the newest Batman movie. Aurora police have not confirmed the report.

At Monday’s hearing, Holmes sat about 30 feet away from the defense table in the jury box rather than sit with his six-person defense team. To his left was Public Defender Tamara Brady and one of eight armed sheriff deputies in the courtroom stood within an arm’s reach.

 The hearing was brief and largely full of housekeeping matters for the defense and prosecution. Judge Sylvester advised Holmes of his constitutional rights and scheduled a hearing for July 30 at which Holmes will be formally advised of the charges against him.

For now, Holmes is facing only a first-degree murder charge and is being held in the Arapahoe County Jail on a no-bond hold. The list of charges against Holmes will likely grow to include at least 12 counts of first-degree murder, as well as other charges connected to the surviving 58 victims who were wounded during the rampage at the Century 16 Theater in Aurora.

Public Defender Daniel King, Holmes’ lead defense attorney, asked that an investigator for the defense have access to not only the theater, but also Holmes’ apartment on Paris Street, where police say Holmes set several booby traps before the shootings.

Chief Deputy District Attorney Karen Pearson, the lead prosecutor on the case, said the defense can have access to the apartment once police deem it safe.

Several of the victims’ relatives were in the courtroom for Monday’s hearing, surrounded by dozens of victim advocates from around the metro area.

One middle-aged man seated at the front of the gallery stared at Holmes the entire hearing, never looking away once Holmes entered the room. A young woman in dark sunglasses shook her head and wiped away tears before the hearing started, at one point saying quietly, “I can’t believe this.” The same woman broke down sobbing as she walked through metal detectors at the courthouse entrance.

After the hearing, District Attorney Carol Chambers said the decision about whether Holmes will face the death penalty if convicted won’t be made until after prosecutors have discussed the decision with the victims and their families.

Prosecutors said they didn’t know if he was being medicated. His demeanor, however, angered victims’ relatives. Tom Teves, whose son, Alex, was killed in the attack, watched Holmes intently throughout the roughly 12-minute hearing, sizing up the 24-year-old former doctoral student.

“I saw the coward in court today and Alex could have wiped the floor with him without breaking a sweat,” Teves said. His son, a physical therapist, dove to protect his girlfriend during “The Dark Knight Rises” shooting at a multiplex in nearby Aurora in the Denver suburbs.

The court appearance gave millions the chance to scrutinize Holmes’ every movement, every flutter of his heavy eyelids and form their opinions.

“It struck me that this is a person who’s been through an emotional maelstrom and therefore might be totally wiped out emotionally,” said Dr. Jeffrey Gardere, an assistant professor of behavioral medicine at Touro College of Osteopathic Medicine.

Gardere said there could be “a psychotic process going on and we see that being acted out there. Or there might be some sort of malingering going on. In other words, trying to make himself look worse than he actually is. Or maybe a combination of all of those things.”

The hearing was the first confirmation that Holmes’ hair was colored. On Friday, there were reports of his hair being red and that he told arresting officers that he was “The Joker.” Batman’s nemesis in the fictional Gotham has brightly colored hair.

Authorities have declined to confirm if Holmers told officers that he was Batman’s enemy. Investigators found a Batman mask inside his apartment, a law enforcement official close to the investigation said Sunday on condition of anonymity because he was not authorized to speak to the news media.

Holmes, whom police say donned body armor and was armed with an AR-15 rifle, a shotgun and handguns during the attack, was arrested shortly afterward. His home was booby-trapped with a trip wire, explosives and unknown liquids that took a day to disarm.

Police have said Holmes began buying guns at Denver-area stores nearly two months before Friday’s shooting and that he received at least 50 packages in four months at his home and at school.

Holmes, who is being held in isolation, is refusing to cooperate, authorities said. They said it could take months to identify a motive.

The shooting was the worst in the U.S. since the Nov. 5, 2009, attack at Fort Hood, Texas. An Army psychiatrist was charged with killing 13 soldiers and civilians and wounding more than two dozen others.

On Monday, security was tight as uniformed sheriff’s deputies were stationed outside, including on the roofs of both court buildings.

Holmes’ entrance into the courtroom was barely noticeable but relatives of shooting victims leaned forward in their seats to catch their first glimpse of him. Two women held hands tightly, one shook her head. One woman’s eyes welled up with tears.

Holmes sat down in a jury box, next to one of his attorneys. When the judge asked him if he understood his rights, his attorneys did all the talking.

Christina “Crispy” Blache, who was shot in both legs during the rampage, watched clips of Holmes’ court appearance afterward with her father, Robert Blache. Her father said Holmes looked insane, while the restaurant manager said she believed Holmes had no idea what he did.

“He seemed kind of out of it, just sitting there. I don’t really know what to think as far as he goes because he didn’t seem remorseful or anything,” she said.

David Sanchez, who waited outside the courthouse during the hearing, said his pregnant daughter escaped without injury but her husband was shot in the head and was in critical condition. His daughter was scheduled to deliver her baby on Monday.

“When it’s your own daughter and she escaped death by mere seconds, I want to say it makes you angry,” Sanchez said. He said his daughter, 21-year-old Katie Medley, and her husband, Caleb, 23, had been waiting for a year to watch the movie.

Asked what punishment is appropriate if Holmes is convicted, Sanchez said, “I think death is.”

Chambers’ office is responsible for the convictions of two of the three people on Colorado’s death row.

Chambers also is the only state district attorney to seek the death penalty in a case in the last five years, said Michael Radelet, a sociology professor at the University of Colorado at Boulder who tracks death penalty cases.

Yet Colorado uses the death penalty relatively sparingly. There has only been one execution since it was reinstated by the U.S. Supreme Court in 1976. The state legislature fell one vote short of abolishing the death penalty in 2009.

At a news conference in San Diego, where Holmes’ family lives, their lawyer, Lisa Damiani, refused to answer questions about him and his relationship to the family. She said later: “Everyone’s concerned” about the possibility of the death penalty.

When asked if they stood by Holmes, Damiani said, “Yes they do. He’s their son.”

Holmes is expected to be formally charged next Monday. He is being held on suspicion of first-degree murder, and he could also face additional counts of aggravated assault and weapons violations. Holmes has been assigned a public defender.

Weeks before, Holmes quit a 35-student Ph.D. program in neuroscience for reasons that aren’t clear. He had earlier taken an intense oral exam that marks the end of the first year but University of Colorado Denver officials would not say if he passed, citing privacy concerns.

At a news conference, university officials refused to answer questions about Holmes. “To the best of our knowledge at this point, we think we did everything that we should have done,” Donald Elliman, the university chancellor.

The judge has issued an order barring lawyers in the case from publicly commenting on matters including evidence, whether a plea deal is in the works or results of any examination or test performed on someone.

Some of the victims’ families, who had traveled to Colorado to attend the hearing, planned to return home to plan funerals. Chambers said her office would keep them informed through various methods, including the news media, while following the judge’s order.

“At this point everyone is interested in a fair trial with a just outcome for everybody involved,” she said.

      To forget the rule of law and the right to a defense would damage us even further as a community.
      We must remail civil, or we will succumb to fear.

The laws in this country should be changed.  When an individual proudly waits to be arrested, his guilt is obvious.  His punishment should fit the crime.  A shotgun blast in the face seems fitting.  He thought nothing of doing that to a stranger who just happened to go to the movies… He is evil not crazy.  What type of defense is there for evil.  Forgiveness, empathy, compassion, and plain goodness overcome evil, but punishment is still require.

    Colorado doesn’t kill anyone and hasn’t for years, all the death (?) penalty does is cost the taxpayers a bunch of money and time, just put him away for the rest of his natural life and call it a day.  PLEASE PLEASE PLEASE.  (were we in Texas or Florida, I’d be on board with going all out for the death phase, ’cause in those states, they still kill ’em, good for them!)

    1. If nobody, except police, were allowed to buy and carry guns or/and ammunition, Holmes couldn’t have killed and injured all these people. With all my appreciation for the Second Amendment, in modern society it causes more harm than benefits.

        Felons and several other types of people are not allowed to purchase or posses
        guns, but they do. Taking the guns away from citizens will not prevent felons
        and others from stealing guns, or making them to put the rest of us in fear
        when we can not be armed to protect ourselves. Protecting ourselves is needed
        and will be a requirement for several years to come until you eliminate the
        criminals and mentally disorientated in our society. Until that happens leave
        the Second Amendment alone.

  7. An Open Letter to the people of Aurora from a “9/11” survivor

    As a “9/11” survivor.  I lost my fiancée Sarah Miller Clark on flight #77 that crashed into the Pentagon; her son lives in Aurora.  One of my first calls on that fateful day in 2001 was to him in Aurora. Of course one of my first calls after learning of the incident at the Century Theater was to check on Sarah’s son, and my aunt who also lives in Aurora. I am happy to report both are well and safe.
     
    I offer my prayers and condolences to the victims and their families, and forgiveness to the shooter. I know it is difficult in these days immediately after such an event to contemplate “forgiveness” however I  attribute my ability to get on with the business of attending to all of the various issues the families will have to tend with to my decision immediately offer forgiveness to the perpetrators and their families. It freed me to get on with the business of jumpstarting my own healing process, and it freed me to make the necessary plans to bring positive closure to the immediate experience of losing my loved one, and to consciously use every opportunity to speak about the experience to highlight the “life” qualities Sarah exhibited so that even in her death she could be a beacon to others.
     
    In the days ahead there will be much to parse; decisions on a memorial service, handling the deceased bills, mail, phone service, automobiles, clothes, keepsakes, estates, the list goes on. Add to this the constant television coverage, the replays, the comments of friends who want to say something but are at a loss for words,,, the moments when the horror grips your entire being; the days when a “big cry” lingers constantly  just below the surface and seems constantly stuck in your throat.
     
    There will be days when you will stare at your loved one’s belongings; the places they once slept, or ate, or danced, their toothbrush, clothes, shoes, (one of the hardest things to deal with will be what to do with their shoes, for some reason many “9/11” survivors remembered more about their loved ones shoes, that other items) of the places they loved and the fact that they are no longer with you on this plane will seem overwhelming. My advice is that you allow these feelings to flow over you, and if necessary, cry, you will find it very helpful. In many case I gave Sarah’s work suits, dresses, blouses etc. to organizations providing assistance to women returning to work. I gave most of her shoes to survivors of Hurricane Katrina.

     Expect the experience to be surreal. It is. Be mindful of your need to eat, although you will not want food. Work out, as exercise is important to relieve the stress; Pray for it is true that God not only answers prayers, but also “Pray-ers.”

     Finally, use every opportunity to assure children you come in contact with in your City, and elsewhere to encourage them to live without fear, love and pray without ceasing, and to continue to believe that despite events such as this America is till the best country in the world to be a citizen of, and that your city Aurora will emerge stronger, more unified and that you are assured of your own healing and renewal.

    1.  Heartfelt and appropriate!  Unlike many of the other things I am reading – as if spewing your hatred and rage will make anything better – it won’t help the families mourning their loved ones and it certainly won’t help prevent future tragedies.  While we all feel anger and look for targets however justifiable – it simply doesn’t change anything.

  12. My best friend from high school killed herself a few months ago. We hadn’t talked in about five months, and the last time we did, I thought something was wrong, but because of my own busy life, I took her assurances that everything was fine and didn’t follow up.  I should have.

    As it turns out, she was hearing voices.  She was schizophrenic.  She told a woman she worked with that the voices were telling her to hurt people – so, she killed herself.

    Honestly, I wish fate had been as kind to Holmes.  He, his family and the poor victims would all have been better off if he’d just harmed himself instead of others.

    That being said – I’ll never forgive myself for not being there for my friend.  Maybe I could have saved her.  You have to wonder about the people in Holme’s life and what they could’ve/should’ve done – and the anquish they must be feeling now.

    RIP to the victims.  What happened was so unfair.

  17. I think all theaters need to put an alarm on an  exit door in a auditorium so that when it is opened it goes off. That way no one can do what this guy did. Prop it open and come back in.

    I have been in theaters which have an alarm and some that don’t. I have been watching a movie and suddenly been blinded by a door opening and sunlight pouring in pitch black theater.

    I think the theater industry should make this a mandatory safety feature. Just an alarm like a lot of emergency exits have. Nothing fancy.

    Maybe we can start a petition to movie theater companies????? Or letter writing campaign??? Any ideas???

    real shooter could have been wearing an orange wig. Did they do a DNA analysis
    of the clothes, the gas mask? Did they test Holmes for gun powder residue on his
    clothes and body? There should be sweat residue and exhaust vapor in the mask
    filter which they could analyze like drugs in his body …but probably
    won’t.

    might run another $800 total. Spare mags, sights, slings, and so on will run you
    at least another $1,000 across three firearms. The bullet-proof vest is easily
    another $800, and the cost of the bomb-making gear is anybody’s guess. With all
    the specialty body gear, ammunition, booby-trap devices and more, I’m guessing
    this is at least $20,000 in weapons and tactical gear, much of which is very
    difficult for civilians to get in the first place.”

    The

    could barely stay awake. Does this look like a person who would be lucid enough

    of who Holmes was and why his eyes were SO dilated at his court hearing on

It is up to YOU to DEMAND the truth. Demand that Holmes be tested for drugs, be tested for gun powder residue (if not too late) , demand the security camera footage. If you don’t you may never get the truth on who attacked your loved one.

You are on-point!  This entire shooting was definitely premeditated, but are we sure it was Holmes.  There are pics that show the gas mask was found at the end of the bldg. close to the main road and isn’t there a security camera both in the front and the back?  If so, where is the video that shows Holmes entering the theatre and buying a ticket…or did he?  Who was the guy in the front row that rec’d a call and than exited out the same door that the shooter came in?  Why was this planned to occur just a week prior the the UN Small Arms Treaty vote expected on July 27th?  Why was it that Holmes wasn’t shot when the police allegedly saw him in full gear with guns on him?  That was what was reported initially and yet the pics of the crime scene show the gear was on the ground, blood on the sidewalk passing by Holmes car?  There was a gun dropped by the exit door and whose pink flip flops were those right outside the door?  Was anyone reported missing?  There was also a guy in Theatre 8 that said he started to exit out the back exit door when he heard the shooting in the next theatre, but when he opened the door, two girls were there and one had been shot.  He let them in and there was the shooter headed to the exit door, but this guy pulled the door shut.  Could there have been more than one shooter in the back of the bldg.?  Could Holmes have been a patsy?  Could Holmes be a manchurian Candidate?  Too many questions and if I lived in Colorado, I wouldn’t be going with just what MSM and the local enforcement are saying, I would demand answers!  There is more to this than we are all being told…

My disabled husband Larry who had severe back pain and depression in his family took his life on July 20th, 2009. 20 days after I lost my job of almost 30 years as a nurse.  I found him outside with my dogs and called 9/11 and had to do CPR and the ambulance took him to the hospital I had just lost my job at.  I signed my name so his organs could be donated.  Getting up on the 3rd anniversary of his death I was very upset to find out what had happened over night in Aurora.  I now know that July 20th will also be an anniversary day for so many of you in Aurora to remember your loved ones.  You will be traveling a long road both physically and mentally for the people who were injured,killed, first responders, friends, family, relatives, loved ones.  You will go though several stages after the deaths and injuries of your loved ones.  PLEASE get Psychological treatment to help in your recovery!  I hope that the laws are tightened and people with mental issues SHOULD NOT be allowed to buy weapons.  As with people who have seizures there should be a data base in each state and these patients reported to the data base so they CAN’T buy weapons or ammo. No US citizen has the need to buy an automatic weapon!  No one!  And you should not be able to buy weapons or ammo on the internet at all.  I know that lots of people are stuck on “The right to bear arms.”  When the constitution was written most people hunted for their food.  This is not true anymore. Also I know of several situations just in my area of Western Michigan where people with weapons tried to protect homes, business and shot at someone and got into legal trouble.  If people don’t have easy access to weapons there will be less of these horrible situations taking place.  Above all God Bless You all in Aurora and take care of yourselves. The rest of the USA and the world is sending good thoughts and praying for you.

  25. I pray the Centennial will be an example of investigative reporting without relying upon AP contributions. It is interesting that the police will not confirm the allegations about wild hair colored red.

    Why not contact the New York Police Commissioner and ask why he gave this statement and how he got the information.

    It may be because the police were looking for this “red dyed hair” character later after another suspect was arrested behind the theater “only minutes” after the shooting. Strangely, the other suspect surrendered without a fight after having killed several people of different ages.

    Ask why they were looking for someone with “wild looking red hair” later after they arrested a suspect behind the theater. It stands to reason that they would not be looking for the same person that was already arrested.

    If the police has the person with “wild looking red hair,” then what happened to the suspect that surrendered behind the theater? Get the police records and reports.

    It’s also interesting to note that the police will not confirm whether
    the arrested suspect was wearing the full military garb at the time of
    the arrest.

    Ask what the suspect was wearing at the time of the arrest behind the theater. As noted above, the Police Chief does not want to comment on this. Has he been ordered to not address this with the public? They don’t seem to mind talking about this character named Holmes and refer to him as the shooter. Why would they not talk about the suspect that was arrested behind the theater?

    Why did the suspect arrested behind the theater tell the police that an apartment was booby-trapped (as initially reported)?

    It’s also interesting that the police were on the scene “only minutes”
    after the shooting and that the suspect did not use the weapons that
    were allegedly on him against the police.

    Initial news reports included witness statements about multiple people such as seeing a man standing near the emergency exit talking on a cell phone only minutes before an assailant entered from the same door; or that smoke devices were tossed in from different sides; and how the assailant was professional and  methodical in the way he targeted people (almost like a robot programmed and trained to kill). After shooting several people, he just surrendered?

    Sorry, but I’m not buying the official conclusion that is being crafted by the national media and certain “authorities.”

    It seems as if Associated Press is assisting to combine the “red dyed hair” suspect, the suspect arrested behind the theater, and the suspect with the cell phone inside the theater into one “lone gunman” suspect.

Yes it is sad that so many innocent people were injured by this incident, but I have read too many comments that state to not ask any questions basically and accept this shooting for what it is.  People, don’t you ask questions?  Don’t you realize most killings to include serial killers and incidences like this similar to Columbine etc. are created by mind controlled puppets?  Do your research.  Since 7/20, I have spent countless hours researching this and the pics from the back of the theatre make zero sense based on what we have been told by law enforcement and the media.  Things are not adding up and it appears there were multiple suspects.  For those of you that live in Colorado, have you seen the pics of the back of the theatre?  There were bloody footprints that passed by the car, the gear that the shooter was supposedly wearing when the cops showed up was actually on the ground near the car, there was a gun by the exit door from Theatre 9 and most of all, there were pink flip flops at that back exit door.  Who do those flip flops belong to?  There were in the pictures of the crime scene.  Finally, the gas mask was at the end of the bldg. close to the main road.  How did it get there?  

    Do not accept anything that you are told w/o conducting your own due diligence.  We have been lied to about so much, why should we trust this story?  If you allow this to all be pinned on one individual, who may just be a patsy, you haven’t done your best to see the Truth.  Seek the Truth and don’t sweep this one under the carpet.  I feel Holmes was a patsy and he was sitting in his car when the police came, he was drugged.  He is guilty by association and an accessory, but he wasn’t the shooter and also who was that at the back of the theatre that threw one of the tear gas cannisters?  Be an investigator, ask questions, seek answers, and most of all, don’t settle for lies, deceit, or rhetoric.  You know there are always security cameras, why aren’t the FBI and the local law enforcement sharing the security camera footage?  What are they hiding?  What really happened at this theatre on July 20th?

A senseless crime of murder, I know all about cause my brother was shot and killed about a cellphone.  Dude got 80 yrs.  in person and he was 26 when this happened 7 yrs. ago.  Hope justice prevails for the the victims and families in Colorado.  My prayers go out to all, May God be with you and Bless all.  When prayers go up blessings come down. Keep a prayer circle going the all victims and their families
