AURORA | An oft-disciplined Aurora cop’s relationship with his fellow officers was so toxic other police officers didn’t want to go on calls for him or work with him, former police Chief Dan Oates testified Monday.

Oates said Officer Chris Falco also made homophobic comments in front of other officers, including to one who was gay. Oates didn’t say exactly what the comments were, but said they were “disgusting” and could have damaged the department had they gone unpunished.

“Had he said this in a public setting I probably would have fired him,” Oates said.

Falco has been embroiled in several disciplinary cases over the years and is now asking the Aurora Civil Service Commission to overturn or amend a 320-hour suspension Oates handed him for shooting at a moving vehicle in 2011. In that case, Falco and another officer were cleared of criminal wrongdoing for shooting at a truck with three auto-parts thieves inside, but because the shooting violated a departmental rule about firing guns at moving cars, Oates suspended Falco.

One person was killed and another man paralyzed in the shootings.

Previously, Oates fired Falco for a variety of infractions — including calling the wounded auto-part thief a “marshmallow head,” babysitting his grandson while on duty, and cursing at a teenager during a traffic stop — but the Civil Service Commission overturned Falco’s firing.

The city appealed that ruling to Arapahoe County District Court, but a judge sided with Falco.

Falco’s latest appeal started last week and is expected to wrap up Tuesday. The commission typically takes one to two weeks to hand down its decision.

In testimony Monday, Oates said one of Falco’s supervisors said he had warned the officer to clean up his act and work better with his fellow officers, but instead Falco was “regressing.”

Jennifer, if you look in a dictionary under marshmallowthere is no terminology about an injured person who is paralyzedits it speaks of ingredients of a marshmallow and how do you really know that this comment was ever made and do you have proof other than what you read on aurora sentinel? By the way, officer falco is back on the streets and has been for quite some time maybe even years it is Oates that is gone not officer falco.       1. Hmmm, well, I said “it sounds like” because all I know in this case is what this story tells me. You could have respectfully offered the facts, which I would be completely open to. However you took a nasty tone with me which makes me not want to engage you further and does nothing for your credibility. And I never said marshmallow head was in the dictionary, I got the term from the Falco quote in the article, hence the “quotes”. Your point about the Aurora Sentinel getting everything wrong however does earn back your credibility points, as I think at this point I put more faith in The Onion. The main point I was trying to make is that the average police officer that I have run in to has been respectful and skilled. Officers are individuals. Most of them are dedicated to their jobs and the community. They cleared the house across the street full of junkies very well, and they handled the dog that lived there well, too. There was the one cop that was always at the 7-11 which is actually in Centennial ALL the time flirting with the clerk and would follow me if I had a t-shirt on that had a pit bull on it. Which I found amusing. Because it’s a t-shirt, and I am not a criminal, and he was using city time to flirt with a 7-11 clerk….. But that was years ago, I haven’t seen him there in years. I don’t know Oates, I don’t know the inner politics of the police dept., although if it’s like other dept. admin,, good lord help us all. Aurora’s policy of requiring the city manager or dept. manager approval for a city employee to even so much as say hello to a council member not only makes it ripe for corruption, but also makes it impossible to make good policy based on the experiences of the people that carry out the work and interact with the public. Arg don’t get me started on that.

  2. There is pervasive corruption in the Aurora city management and the Aurora police department. Brandon Johanson and the Aurora Sentinel in general have failed in their duty to inform the citizens of Aurora about that corruption. This story written by Johanson uses the testimony of the long ago discredited Dan Oates as if that testimony were fact. Other testimony in the hearing shows that Oates and other police command created a web of lies to fire Officer Falco, only to have the civil service commission see through those lies and reinstate him. Oates and others doubled down on their lies, as well as made up more lies to suspend Falco. Had Johanson paid attention to the rest of the hearing, and not had such a crush on Oates, he would never have written this story. Citizen of Aurora, we deserve better reporting than this. The Sentinel needs to hire reporters that are not so easily fooled, and that actually do their job.

          Pull the transcripts of the final hearing regarding my husband and you will read what I witnessed in court under Oath; The 17 yoa girl and her mother testified under oathe that none of the Officers were disrespectful even Falco, so Someone lied and Falco knows who it was another officer. 
          The comment about the Marshmallow was stated in roll when another officer told Falco, that the guys who wanted to kill him and his partner was getting paid out before the officers were cleared which is not common prodocol, but again some moron ran to Oates like a little Snitch over hearing that comment.
          I have attended the Roll Call rooms, and I have heard way more ludicrous words or comments from police officers so grow a pair… this is not a shocker you cops, really.
          Remember that are always two sides to a story or just pull the transcripts and read the notorious lies from corrupted police commanders or even from the police chief, who was caught in many lies. Oh, the grandson is true, how many cops have brought their children to their jobs? Falco was working at the AMC, doing police security while his case was pending. The grandson and I, left 45 minutes later, but one little Snitch just saw Falco with grandson while I went to grab us dinner at a fast food restaurant to bring back. Oh, you didn’t hear that flowing around, of course not Oates didn’t want it out!
          Oates is gone, people and Falco is still with APD.         Pay particular attention to the testimony of Dan Oates as Brian Reynolds (Officer Falco’s attorney) questions him. I only wish I had thought to video tape him to share with everyone.

    3. Ashley, the city does a great deal of advertising in the Sentinel. Do you really think the paper is going to bite the hand that feeds it? Look at the story under election of pit bulls, pot, and taxes going to voters in November and you will see 29 comments, 28 of which are about pit bulls. The city doesn’t want people talking about taxes, corruption, high price of water, or any number of other things. The Sentinel may as well be owned by the advertisers.

      1. Nick, I don’t think that advertisers own the city. I just think they have the monopoly on those, and it does no good to write about them in the sentinel. Complain at the individual services, knowing they will pat you on the head, and console you. But we do it anyway. As for the pit bulls, any large, noisy animal in a city can and does disrupt the whole neighborhood. The two I wrote about being aggressive, getting 3 visits from dog warden with police on last call, resulted in those dogs being moved somewhere else. Now quiet on our street, and the stray cats also appreciate that. The dogs still here, do not bark in the night as much, so I would say action taken was well received. Will still vote against removing that ban, but would like to see ordinance bit tougher. We had real problem several years ago with stray dogs, and recently it seemed to be coming back again. As for Ashley’s remark, when she is so strong in denouncing police (certain ones) it would behoove her to name them, and justify it with written complaints to proper officials. Or let it go, if she does not have evidence.

Therefore, I don’t really think she will get the results from posting here. If she has direct evidence, that needs to be in court. Just enflaming on Sentinel tells those of us with no power to change anything. I browse comments from across USA, and every police department is changing leadership, and is embroiled in lawsuits. At same time, we have people in every one of those cities who shoot police while sitting in cars, eating lunch, or just driving by them. And if we don’t change attitudes of those (young or old) our streets will soon look like those on the National News. We are close to race war, religious war, economy war in our streets. Reason FEMA, Federal Agencies, and Police are buying weapons, ammunition. And I am not paranoid about that. Police used to have possibly one SWAT team in whole section of city, now they are busting down doors on regular news channels. Yet we cannot close our borders, know who is in country, or even why they are here. Not intending to become citizens either, as some of my neighbors from south of the border. Have now moved to other areas. Thank God. But my property values decreased as all others in my part of Aurora. It is all part of the package. Police are doing their jobs, but much tougher these days. Sorry for length of reply, but we are paying for this. And changing chief won’t change much.

          2. Long time later from my comment. Now that we know who chief will be, do you expect to see some visible means of knowing of changes? One big problem in balancing police force on racial, views, and attitudes is too many minority students drop out of school in grade, high school, college and never acquire the level of competence to write reports, or complete police or fireman academies or training. We have those who come back from military and go into those fields, and are very capable. We have those completing college and wanting to be police or firemen, who are capable. Then we have the citizen attitudes, shaped by media of being bullies or who exceed need for force, to patrol our streets, and enforce the laws. But with overall attacks of police, firemen, and military in peace time, just who will be hired or even want to be hired? And I read the comments across this country, and have seen this. So shifting the chief, does not change the political atmosphere and demands, under which that chief runs department. Not to mention, the resistance of those on that force for long periods. As one of my subordinates in military stated one morning with commanding officer came in from night of revelry, and jumped his case for talking too loud:
            “Sir, I can work for you 8 hours a day, or against you for 24 hours a day”. Commander was smart enough to go into his office, close the door, and never mention It again.
            –And I did not counsel my subordinate about that either. But the message was well learned by that commander. I don’t know the interior part of this issue, but I know of the shooting, and agree whole-heartedly with Officer Falco. Those thieves made the decision when they entered to steal what was not theirs, and I would have shot. And trying to run down the officers is not correct action on their part. This is long, but I support police, firemen, and being military retired 26 years service, I definitely support the military. None of us need to be shot at on USA streets because someone has an attitude or agenda.

  3. I attended the Civil Service Commission hearings. The following is what I took away from the process:
    There have been several important pieces of information that have come to light during the hearing for Officer Falco. First is that there was a complete investigation done by the Major Crime Unit of the Aurora Police Department, the Arapahoe County Coroner’s Office, and the Arapahoe County District Attorney’s Office. The outcome of the investigation was that Officer Falco and another officer that used deadly force were justified in using that force. Other information that came out during this hearing was that Dan Oates refused to accept that investigation, and paid $96,000.00 to have a private firm conduct a second investigation using only information chosen by Oates. That secondary investigation had a different outcome, and Oates decided to use the results of that second investigation to suspend Officer Falco. Now it is known that the outcome of that second investigation was complete garbage and not usable since it ignored many of the most important facts of the case.

    Dan Oates testified that he and the City Attorney conspired to refuse orders from both the Aurora Civil Service Commission and the District Court Judge that ordered Oates to return Officer Falco to the job for which he was hired. Oates also testified that he was not aware that the City Attorney used his position to influence the Civil Service Commission during deliberations (a crime) on the first Falco hearing. What will likely be brought out soon is that influence was used in other Aurora Civil Service hearings and that many city officials were aware of the violations but did nothing to control the corruption.

Maybe most of the people should have been there when Danny boy stated under oath, “I find the civil service commission’s power and the District Court decision to be ABSURD.” Wonder how the contempt citation from Judge Hannon will feel!! Goes to show you that Danny boy believes he is more powerful than any district court ruling. Too bad I am not Falco I would already be spending the hundreds of thousands the City of Aurora is going to have to pay him!!!!!!

  5. There were multiple fumbles of the ball between Oates and his crew.
    Retired Division Chief Roger Cloyd said a part of the reason for the policy of officer’s not shooting into a moving vehicle is because innocent bystanders might get hurt.
    Chief Oates said today that the officers should/could have used a different tactical plan. He suggested they let the thiefs leave the parking lot and allow more officers to surround them at a traffic light.
    Wait a minute here. This whole event happened in a “no mans land” of a salvage yard parking lot, late at night, away from the citizenry. So, the chief thinks it would have been better to allow the action out of that lot, onto the street, where you and I could potentially get smashed/maimed/killed in the process?
    Sounds like a great tactical alternative plan to me Dan!
    Either show up for these hearings or request the transcripts and READ.

    PEOPLE there is a true fact reason for this and don’t be miss lead by aurora senitnel editors date you will have to explain they’re vicious attacks on this one officer. all I can say to this one officer named falco is that I wish him the best of luck for the long term harassment that he has received from cheesy Oates, and the aurora sentinel editors Brandon, dave perry that I wish all the accusations of what city taxpayers money was paid out it was not this officer it was the city, all of those named above that are retired or gone used this money for other nonsense reasons blaming it on this officer of a shooting that was justified he was the only one that they used or set up why the city had used over a million dollars. Oates and his retired staff used one million in tax payers money and had access to it by using this officer and a shooting that was justified to hid the money. But what you don’t know is that all of them are gone. Oates was the last to leave taking on a new chief job in Miami Beach, but I hear that he has already pissed them off and that does not surprise me. And, this stupid newspaper called aurora sentinel is trying to do anything for the ex chief to cover his very inappropriate actions and I am not so sure that In the end none if this looks good for Oates and Auror Sentinel. if you read a person named Ashley comments, my guess is this person sure in the hell knows what they are talking about and is sure you what Ashley is saying is in fact, the pure truth!

  12. This problem is due to our President and his cabinet appointed Directors not living up to their oaths of office to enforce the laws of the country. Borders were supposed to be closed to illegal aliens by law signed by President Reagan in 1986, when Sen. Teddy Kennedy assured all of us that with amnesty to 3 million illegal aliens in country, the problem would never occur again. Since then administrations have tightened border crossings, then others loosened them. This administration gives lip service, but those young men stealing parts from cars, should not have been in country , or should have been in jail-prison. That night, in dark, they made choice to steal parts, and then tried to run over officers to escape. Led to shooting, death, and injury. And this sore has rankled with all the bleeding hearts on juries, with our tangled enforcement/ non-enforcement of laws. Chief Oates is caught in controlling police department, but with others changing his control, or rescinding it.
    During my 26 years in military, I saw this occur and when management cannot follow policies or standards, people get replaced. But this cancer started with President, and seeps all the way down to our city. We civilians – constituents have opinions, but have to live with flux. Not necessarily corruption, but impossible for all concerned. I see Officer Falco doing his job, but not having the backing he needs, and I see unions, oversight people, bleeding heart jurists, judges all contaminating “rule of law”, and we WIND UP WITH RULE OF PEOPLE. That leads to anarchy and confusion. Also I had experience of having a policeman tell me after out of control neighbor threatened to kill me, “You have to learn to live with these people”. He had kept our part of Aurora upset for 4 years – arrested 15 times and 3 times by his own mother’s complaint. For those years, only time it was entirely quiet on our block, was while he was in jail. Finally moved.

    1. On some level Frank, I couldn’t agree with you more. Although, I do not know if these particular male theifs were here illegal or otherwise.
      Today, I was wondering what would have happened if this same situation had gone down in Russia with their police and young American males?
      Would a Russian chief have felt the same compassion for our American males when committing a criminal act over there?

    Pull the transcripts of the final hearing regarding my husband and you will read what I witnessed in court under Oath; The 17 yoa girl and her mother testified under oathe that none of the Officers were disrespectful even Falco, so Someone lied and Falco knows who it was another officer. 
    The comment about the Marshmallow was stated in roll when another officer told Falco, that the guys who wanted to kill him and his partner was getting paid out before the officers were cleared which is not common prodocol, but again some moron ran to Oates like a little Snitch over hearing that comment.
    I have attended the Roll Call rooms, and I have heard way more ludicrous words or comments from police officers so grow a pair… this is not a shocker you cops, really.
    Remember that are always two sides to a story or just pull the transcripts and read the notorious lies from corrupted police commanders or even from the police chief, who was caught in many lies. Oh, the grandson is true, how many cops have brought their children to their jobs? Falco was working at the AMC, doing police security while his case was pending. The grandson and I, left 45 minutes later, but one little Snitch just saw Falco with grandson while I went to grab us dinner at a fast food restaurant to bring back. Oh, you didn’t hear that flowing around, of course not Oates didn’t want it out!
    Oates is gone, people and Falco is still with APD. He is a Licensed General Contractor and a hard working man, unlike little snitches that have no other talents, but Snitches and kiss asses to those that ask for —- false trash! Yes, those snitches are cops, the ones that laugh & joke with you. Yep, those ones, and we know who you are your Oates isn’t around anymore to save you!
